I've downloaded the application, but didn't find any source code files listed in the installation directory. Indeed, the software is using open-source components, but I don't think the open-source license applies to the app as well.
I recommend contacting the developer of MP3Tools to find out exactly what is the license status. Luckily, his website is still working and you can send him an inquiry right away.
